A clear OSHA violation

A boom truck is hoisting a guy on the hook to install flags atop light poles at a used car dealership. It appears that he is simply rigged to the hook.

A clear violation of O.S.H.A. Code 1910.180 (h)(3)(v)

OSHA Standard Interpretations 03/01/1989 – When and how is it permissible for employees to be hoisted on the load lines of cranes and derricks.

Forbidden by OSHA regulation Title 29, 1926.550 Code of Federal Regulations, limits the use of personnel hoisting in the construction industry and prescribes the proper safety measures for these operations.

Violation of Cal-OSHA Rules

This incident was done out in the open public for anyone to see or take photos of, including competitors. Obviously, someone did just that.

Also, it appears the general public was allowed in the area at the same time. If you look closely you'll see several people scattered throughout the work area.

No barricades are showing in the several photos we received.

One of our supporters sent the following: "Not only is he hoisting a guy, but over the front too. I never saw a boom truck with any kind of a chart for working over the front. As soon as you swing past that front outrigger you are without outriggers as far as the chart goes. Also the guy on the hook must be a few bricks short of a load too."

If something had gone wrong the legal profession would have had a hey-day with this one. The crane operator subjected himself, his employer and the dealership to liability, and possibly bodily harm to others.

The dealership had every right to expect the crane company and its employees to comply with all laws governing such lifts, they also had a right to expect the lifting to be done in a safe, professional manner. Neither was done. Surely in most, if not all states, there are laws that require a crane rental company to meet the above expections of a client.

Fortunately, nothing went wrong and no one was injured. However, if at sometime in the future the crane company does have an accident, this incident will in all likelyhood come up. --D. Peeks
